Euphoria Golf Estate & Hydro

The 760 hectare Nature Reserve is situated on the Estate and is stocked with Kudu, Impala, Waterbuck, Rooi Haartebeest, Bush Buck, Blesbuck and other small buck which all occur naturally in the area.

These animals can also be found grazing on the golf course. Leopard is indigenous to the area and can also be spotted in the Reserve.

The region is also well known as a bird-watching destination and up to 250 species have been identified in the area. The reserve is located only 10km from the world-famous Nylsvlei Bird Sanctuary.

Guest are able to enjoy guided nature drives in open vehicles, as well as night drives on the golf course. Hiking trails, quad bike trails and cycling is also available in the Nature Reserve.

6. CANCELLATION OR POSTPONEMENT OF THE FUNCTION BY THE CLIENT
6.1 Should the Client cancel the function after the fulfilment of the provisions contained in clause 1.1, the client shall:-
6.1.1 Notify Orion of such cancellation in writing; and
6.1.2 be liable to Orion for payment of cancellation charges as follows, irrespective of the Client having notified Orion as envisaged in clause 6.1.1 or not:
6.1.1.1 cancellation 59-30 days prior to the function date, 25% (twenty five percent) of the rates specified in the Quotation;

6.1.1.2 cancellation 29-15 days prior to the function date, 50% (fifty percent) of the rate specified in the Quotation;
6.1.1.3 Cancellation 14 days or less prior to the function date, the Client shall pay to Orion 100% (one hundred percent) of the rates specified in the Quotation.

6.2 In the event that the Client wanting to postpone the event:

6.2.1 Orion will keep the deposit and prepayment and charge a postponement fee according to clause 6.2.4 below, based on the estimated rates in respect of the function, including accommodation rates, on date of postponement to be deducted from deposit and/or prepayment, if same was received. If no deposit and/or prepayment was made, Client will be invoiced accordingly;

6.2.2 Orion will not refund the deposit and prepayment and it will be held as deposit and prepayment for such postponed date of the function;

6.2.3 The client will notify Orion of such postponement in writing, such notice will also include the date to which event is to be postponed to, which date will be confirmed by Orion subject to availability. If on postponement no postponement date is provided, such postponement will be deemed to be a cancellation and the provisions of clause 6.1 will be applicable;

6.2.4 Orion will be entitled to charge a fee for the postponement, such fee based on a percentage of the rates quoted and confirmed in respect of the function inclusive of accommodation, which fee will become due and payable on date of postponement and which fee may be recovered from the deposit and/or prepayment:

6.2.4.1 In the event of the function being postponed 14 (fourteen) or more days prior to the function, Orion will charge a fee of 5% (five percent) of the estimated event fees as quoted;

6.2.4.2 In the event of the function being postponed less than 14 (fourteen) days prior to the function and the new function date be confirmed for the same calendar month as in which the function was originally booked, a postponement fee of 5% (five percent) of the fee as quoted will be due and payable;

6.2.4.3 In the event of the function being postponed less than 14 (fourteen) days prior to the function and the new function date be confirmed for a subsequent calendar month following the month in which the function was originally booked, a postponement fee of 50% (fifty percent) of the fee as quoted will be due and payable;

6.3 Once a function has been postponed once as per the terms and conditions of this agreement, is cannot be postponed for a second time, and should a second postponement be required or should the postponed function be cancelled, the full cancellation fee as per clause 6.2.5.2 will become due and payable irrespective of any other term on condition in this agreement.

6.4 Orion shall be entitled to retain any monies already paid by the Client in full or partial settlement, as the case may be, of the cancellation and/or postponement charges as set out above or as liquidated damages for cancellation and/or postponement without negating Orion’s right to instituted action for recovery of action damages suffered due to the contact of the Client which cancelled and/or postponed.
7. CANCELLATION OF FUNCTION BY ORION
Should Orion be prevented from fulfilling its obligations in terms of this Agreement as a result of the destruction of or damage to the venue, any system malfunction, industrial action, war, political unrest, act of God, Government interference or as result of vis major or casus fortuitus, any other circumstances beyond the control of Orion or for any other reason whatsoever, Orion shall be entitled, in its sole and unfettered discretion to cancel the Agreement and to refund to the Client such amounts as may have been paid in terms of this Agreement.
